- Depending upon the industry, Non-Compete Agreements and Covenants Against Solicitation can prohibit Employees from being fully successful in their new role once they have moved over from a competing firm. This can have negative effects ranging from increased frustration and attrition due to the ramp-up time involved, elimination of candidates from the process for fear of future litigation, and unnecessary legal costs as a result of these agreements being enforced.
